1 Acceptance of Terms

By accessing or using BuyNSell (“the Service”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, you must not access or use the Service.

These Terms constitute a legally binding agreement between you and BuyNSell. We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

2 Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

If you are using the Service on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms.

3 Account Registration & Authentication

To access certain features of the Service, you must register for an account. You may register using:

• Email and password registration.
• Google (Gmail) Login via OAuth 2.0 authentication.
• Apple Login via Sign in with Apple.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Provide accurate, current, and complete information during registration.
• Keep your account information up to date.
• Notify us immediately of any unauthorised use of your account.
• Not share your account credentials with third parties.

4 Nature of the Service

BuyNSell is an online marketplace platform that connects buyers and sellers. We provide the platform for listing products and services; we are not a party to any transaction between buyers and sellers.

• No On-Site Payments: We do not process, facilitate, or handle payments between buyers and sellers. All payment arrangements are made directly between the transacting parties outside of our platform.
• No Guarantee: We do not guarantee the quality, safety, legality, or availability of any product or service listed on the platform.
• Intermediary Role: We act solely as an intermediary platform. We are not responsible for the conduct of any buyer or seller.

5 Seller Obligations

If you use the Service as a seller, you agree to:

• Provide accurate and truthful descriptions, images, and pricing for your listings.
• Only list products and services that you are legally permitted to sell.
• Comply with all applicable local, national, and international laws and regulations.
• Honour any commitments made to buyers through the platform.
• Not list prohibited, illegal, counterfeit, or infringing items.
• Maintain a valid and active store profile with accurate business information.

We reserve the right to remove any listing or suspend any seller account that violates these Terms or our policies without prior notice.

6 Buyer Responsibilities

If you use the Service as a buyer, you acknowledge that:

• You are responsible for verifying the quality, authenticity, and suitability of products before purchasing.
• All transactions are conducted directly between you and the seller, outside of the platform.
• BuyNSell is not responsible for any disputes, refunds, or issues arising from transactions.
• You should exercise caution and due diligence when engaging with sellers.

7 Social Media Integration

Our Service offers optional integration with Meta platforms (Facebook and Instagram) for automatic product listing publication. By enabling this feature, you agree to:

• Authorisation: You authorise BuyNSell to publish product listings on your connected Facebook Page and/or Instagram Business Account on your behalf.
• Content Ownership: You retain ownership of all content posted through the integration. You are responsible for ensuring your content complies with Meta’s terms of service and community standards.
• Compliance: You agree to comply with Facebook’s Terms of Service, Instagram’s Terms of Use, and Meta’s Platform Terms.
• Revocation: You may disconnect the integration at any time through your store settings. Previously published posts will remain on your social media pages.

We are not responsible for any actions taken by Meta, including content removal, account restrictions, or policy enforcement on your social media accounts.

8 Prohibited Activities

You agree not to:

• Use the Service for any illegal or unauthorised purpose.
• Post false, misleading, or deceptive listings or information.
• Infringe on the intellectual property rights of others.
• Harass, abuse, or harm other users of the platform.
• Attempt to gain unauthorised access to the Service, other accounts, or systems.
• Use automated bots, scrapers, or similar tools to access or collect data from the Service without authorisation.
• Manipulate reviews, ratings, or search rankings.
• List prohibited items including but not limited to: illegal substances, weapons, stolen goods, counterfeit items, or items that violate local regulations.
• Circumvent or attempt to circumvent any security measures of the Service.
• Use the Service to distribute spam, malware, or unsolicited communications.

9 Intellectual Property

The Service, including its design, logos, trademarks, text, graphics, and software, is owned by BuyNSell and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our intellectual property without prior written consent.

By posting content on the platform (including listings, images, and descriptions), you grant BuyNSell a non-exclusive, worldwide, royalty-free licence to display, distribute, and promote your content within the Service and through connected social media integrations you have enabled.

10 Limitation of Liability

To the maximum extent permitted by law, BuyNSell shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages.
• Loss of profits, data, business, or goodwill.
• Any transactions, disputes, or arrangements between buyers and sellers.
• The quality, safety, legality, or availability of listed products or services.
• Any content posted by users, including listings, reviews, or communications.
• Actions or content on third-party platforms (Facebook, Instagram, Google, Apple) resulting from integrations.
• Service interruptions, errors, or security breaches beyond our reasonable control.

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied.

11 Indemnification

You agree to indemnify, defend, and hold harmless BuyNSell, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, your violation of any third-party rights, or your content posted on the platform.

12 Account Termination

We may suspend or terminate your account at our sole discretion, with or without notice, for reasons including but not limited to:

• Violation of these Terms or our policies.
• Fraudulent, abusive, or illegal activity.
• Extended periods of inactivity.
• Request by law enforcement or government agencies.

You may also delete your account at any time. Upon termination, your right to use the Service ceases immediately, and we may delete your account data in accordance with our Privacy Policy.

13 Dispute Resolution

Any disputes arising from these Terms or the use of the Service shall be resolved as follows:

• Between Buyers and Sellers: Disputes between buyers and sellers are to be resolved directly between the parties. BuyNSell may, at its discretion, assist in mediation but is not obligated to do so.
• With BuyNSell: Any disputes between you and BuyNSell shall be governed by the laws of the Republic of Maldives and subject to the exclusive jurisdiction of the courts of the Maldives.

14 Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
